POLICY STATEMENT ON THE PROCESSING OF PERSONAL DATA PURSUANT TO ARTICLE 13 OF LEGISLATIVE DECREE196/2003The undersigned company Air Dolomiti S.p.A. Linee Aeree Regionali Europee, in the person of its legal representative Michael Kraus, with registered offices at Via Paolo Bembo 70, Dossobuono di Villafranca (VR), tel. +39 045 8605211 e fax +39 0481474540, “Controller” of the processing of personal data, pursuant to Legislative Decree 196/2003, is required to provide some information regarding the use of personal data. We therefore inform you that the personal data you have provided to Air Dolomiti S.p.A. Linee Aeree Regionali Europee inherent in, related to and/or essential for your placement may be subject to processing in conformity with the aforesaid decree and the obligations of confidentiality. The processing of personal data means their collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, interconnection, blockage, disclosure, cancellation and destruction or any combination of two or more of these operations.
Purposes of processing.The personal data and any sensitive data in the possession of Air Dolomiti S.p.A. Linee Aeree Regionali Europee will be processed solely for purposes related to the mutual obligations deriving from the selection of employment candidates. More specifically, the data will be processed:
- to fulfill, or request fulfillment, of specific obligations or to perform tasks required by law, or by EU regulations, as well as tasks regarding the protection of health, order and public security;
- to identify the most suitable profile to meet the requirements of the company with regard to placement
- to archive and store the profiles favorably judged or to contact you when and how the company will deem appropriate.
- to cross-compare them with the profiles of other candidates or for selection (without processing), by means of electronic instruments, of the characteristics and requisites being sought, such as age, gender, educational level, etc.
Procedure and processing of the data.The data will be processed with instruments that will keep them secure and confidential and that may include both manual and automatic instruments (both computer- and web-based) for their storage, management and transmission. In the case of sensitive data, Air Dolomiti S.p.A. Linee Aeree Regionali Europee takes every precaution in applying its confidentiality policy.
We would further inform you that your personal data will be processed in conformity with the procedures indicated in Article 11 of Legislative Decree 196/2003, which prescribes, inter alia, that the data be:
- processed lawfully and correctly;
- collected and recorded for definite, explicit and legitimate purposes;
- exact and, if necessary, updated;
- pertinent, complete and not excessive with respect to the processing formality.
Copies or originals of documents containing your personal data can be delivered to your spouse or cohabitant, relatives and kin, and/or your employees and/or collaborators.
Categories of persons to whom they can be disclosed.Please note that the personal data inherent, connected with and/or essential to your relationship may be disclosed: to the law enforcement authorities; to Lufthansa, to attorneys; to labor consultants, to persons to whom the right to access your data is recognized by law or secondary or EU regulations; to persons to whom the disclosure of your data is necessary or in any case useful for management of the relationship. Your data will in no case be disseminated.
Rights of the data subject.
At any time you may exercise your rights with respect to the processing controller, pursuant to Article 7 of Legislative Decree 196/2003, which we reproduce here in its entirety for your convenience:
Article 7 of Legislative Decree 196/2003 – Right of access to personal data and other rights
1. Data subjects shall have the right to obtain confirmation as to whether or not personal data concerning them exist, even if the data have not yet been recorded, and communication of such data in intelligible form. 2. Data subjects shall have the right to information on: the source of the personal data; the purposes and modes of processing; the logic applied when the data is processed with the use of electronic instruments; the identity of the data controller, data processing officers and the representative designated pursuant to Article 5.2; the parties or categories of parties to which the personal data can be transferred or which can gain knowledge of them as designated representatives of the State, processing officers, or processors. 3. Data subjects shall have the right to obtain: the updating, correction or, when they are interested, additions to the data; the cancellation, transformation into anonymous form, or blocking of data processed in violation of law, including those that need not be retained for the purposes for which the data were collected or subsequently processed; certification that the parties to which the data have been transferred or disseminated have been notified of the operations specified in points a) and b), also regarding their content, except for the case where notification proves impossible or requires the use of means clearly disproportionate to the right being protected .4. Data subjects shall have the right to oppose, wholly or in part: a) for legitimate reasons the processing of their personal even when it pertains to the purpose of collection; b) the processing of their personal data for the purpose of sending advertising or direct marketing material or to conduct market research or commercial communication surveys. Consequences of the total or partial withholding of the data.Please be informed that providing your data is voluntary but that partial or non-disclosure of those data may make it objectively impossible for this company to fulfill its legal and/or contractual obligations related to the employment relationship.
Duration of processingPlease be informed that the data provided will be processed for the duration of your employment or retained for purely personal reasons and will not be systematically transmitted or disseminated;
